Terms and Conditions

 Article 1. General
The General Terms and Conditions of Sale apply to every agreement between Floratuin and the other party. When placing an order by the other party, the other party accepts the General Terms and Conditions of Sale.
Deviation from the Terms and Conditions of Sale is only possible if written agreement and approval has been reached with De Floratuin. The sales conditions respect the rights of the consumer according to consumer law generally applicable in the Netherlands.

Article 2. Offers/agreements
An agreement is only concluded by acceptance of your order. After payment of the order by the other party, Floratuin reserves the right to refuse an order, to adjust or to attach conditions to the content of the agreement, the method of delivery, etc. Floratuin undertakes to (working) days to inform the other party of this for reasons of its own and to give the other party the opportunity to accept the announced decision or to declare the agreement null and void.

Article 3. Shipping costs
For orders in The Netherlands below € 65.00 we charge € 6.00 Orders in the Netherlands above € 65.00 free shipping

For orders to Belgium, Germany, Luxembourg;
under 65 euros we charge 10 euros shipping costs. Orders above 65 euros free shipping.

For all other countries within the EU: € 14 or € 20 shipping costs. With a minimum order amount of € 20.00.

Article 4. Availability of articles
If the agreement concerns natural products, Floratuin undertakes as much as possible to deliver the ordered items. If an article is not available due to a bad harvest result, Floratuin will make a proposal to replace the article.

Article 5. Retention of title
Ownership and with that right of ownership as well as the obligations with regard to the ordered goods only pass when physical delivery of the goods to the other party has taken place. Until that time, Floratuin has a duty of care with regard to the items ordered by the other party.

Article 6. Complaints, liability and responsibility
After receipt of the ordered, the other party must immediately inform itself that the received goods correspond to the ordered and are in good condition. If it turns out not to be correct, the other party undertakes to report the observed deviations in writing within 7 days. The report must be supported by images of the observed deviation. De Floratuin undertakes to propose a suitable solution that is satisfactory for the other party as well as for De Floratuin. Notification of the observed deviation must be made via: info@floratuin.com or call

tel. 06-10694149. The other party is itself responsible for the correct use of the delivered goods. De Floratuin is not liable for negative consequences of injudicious, improper or incorrect use or abuse of the delivered goods. The costs of the return are for the account of the other party.

Article 7. Change of address
In order to be able to deliver the order correctly and on time, changes in the delivery address must be communicated to De Floratuin before 1 September info@floratuin.com . Floratuin cannot guarantee correct and timely delivery for changes that have taken place after 1 September of the relevant year.

Article 8. Packages not received
If the package has not been received for reasons other than incorrect addressing, the order will be re-sent. If possible and desirable in the same year and otherwise the year after. No credits will be paid. Only redelivery is possible.

Article 9. Compensation
Any compensation due to incorrect and/or poor quality deliveries, reported in accordance with Article 6, will preferably be paid by resending the ordered item. If this is not possible, the compensation will never exceed the amount of the ordered.

Article 10. Protection of personal data
In order to be able to accept your order and to handle it with the right care, we need some information from you. All information you provide will be treated confidentially, in accordance with national and European regulations. We will never transfer your data to third parties.

Article 11. Returning your purchase
If you wish to revoke the agreement, you must notify us within 14 days of receipt. You can do this by telephone, in writing or by e-mail. We can deliver you the same product, offer you a voucher for the total amount or give you a full refund (including any shipping costs). You must return the products to us within 14 days of receipt. We will refund your purchase amount within 14 days of receipt of the products.
